Llibertat d'expressió

Llibertat d'expressió

Urías, Joaquín

Freedom of expression has always been persecuted. Power has always been afraid of messages that are beyond its control circulating freely. So current threats are nothing new. However, nowadays, for the first time in centuries, we almost unanimously accept that everyone should be able to express their ideas even if they are annoying to those in power. Or even, above all, if they are annoying to those in power. At least, in theory. In practice, it is a right that often comes to nothing. Unlike other fundamental rights, it seems that freedom of expression does not have an essential intangible content for public powers. This book tries to put an end to that idea. It focuses on clarifying what exactly freedom of expression is and offers a concise but profound idea of its legal regime. It starts from the historical background that shows when and why political power became aware of the power of words. It tells how he tried to control them and how, in the face of this, the idea that there is no democracy without the free exchange of ideas has slowly but unstoppably made its way. He then explains, in an accessible manner for the layman, how it is regulated in our Constitution and in which cases citizens can invoke it to express themselves with the security of not being able to be disturbed by it. It traces, in the end, the current panorama and the current threats to free expression, which are often hidden not so much in the form of dictatorship but of political correctness or hate speech. In short, it aims to serve as an authentic guide to the use of freedom of expression.
